A Tortfeasor's Liability Policy Limits are a setoff against Underinsured Motorist Policy Limits. This is the rule in Illinois, as in most U.S. jurisdictions. They are not set off against the Policyholders' Catastrophic Damages. Such is the holding in Download Wehrle v. Cincinnati Ins. Co. *2, *4 (N.D. Ill. Memorandum Opinion and Order Filed August 21, 2012).
This rule was applied because the UIM Policy at issue in that case required that a Tortfeasor's Liability Limits be set off against the UIM Policy Limits. That the UIM Statutes authorized the Policy provision determined the outcome. See Download Wehrle v. Cincinnati Ins. Co. *2 (N.D. Ill. Memorandum Opinion and Order Filed August 21, 2012).
