Not even the National Mortgage Settlement reached years ago has stopped lender force-placed insurance ("LFPI") practices or lawsuits involving LFPI practices.
Cases are still being filed. The Court in the following case reported its decision on Friday, December 11, 2015, granting a defendant's motion to dismiss and affording the plaintiff the opportunity to replead. This case was filed in June, 2015. It involves alleged practices of a loan servicer through April, 2015: Gail Bennett-Wofford v. Bayview Loan Servicing, LLC, No. 15-cv-02445-SI, 2015 WL 8527333 (N.D. Cal. December 11, 2015).
An old saying applies in December, 2015: Everything is changing. Nothing is new.
