It is what we say it is because we say it is.
They are called mandatory pre-dispute arbitration agreements. Translated from the lawyer tongue, this means you cannot sue them. See Katie Benner, "Airbnb Vows to Fight Racism, but Its Users Can’t Sue to Prompt Fairness" (New York Times Online posted June 19, 2016).
But if you don't use their service, you can't sue them because you don't have standing.
And if you arbitrate with them, no-one will ever know what it was about because arbitrations are a secret.
When will insurance companies be silently immunized this way too?
And when did the United States of America become a Third World Country?
