Hurricane Irma insurance claims keep rising in Florida, but most of these claims will reportedly not be paid by carriers because they will not exceed the standard hurricane deductible.
On the other hand, exclusions may or may not apply even if the claims exceed any applicable deductible. In Wheeler v. Allstate Ins. Co., 687 F. App'x 757 (10th Cir. 2017) (case involved Utah substantive law), an exclusion in a homeowner's policy did not apply with respect to short-term damage caused by water seeping into the home over weeks, months, or even years. In this case, the policyholder successfully contested the seepage exclusion with respect to "short-term damage (i.e., damage fully inflicted in 13 days or less) to his cabin[.]"
